“Are Car Thieves Bad Drivers? Reasonable Foreseeability and the Decision in Rankin’s Garage”
Harper Grey partner Jonathan Meadows and articling student Dominic Wan co-authored the article Are Car Thieves Bad Drivers? Reasonable foreseeability and the Decision in Rankin’s Garage. The article originally produced for the CLEBC Nov 28 Insurance Law Conference, was recently republished in the 37 Can. J. Ins. L. – January 2019 edition of the Canadian Journal of Insurance Law.
In finding a duty of care was not established in this case, the court outlined the principles that should continue to guide courts in assessing whether a duty of care exists. This paper sets out the context in which these refinements were made and examines the clarifications outlined by the Supreme Court of Canada.
