On February 10, 2015, Roselle Wu (Harper Grey) and Amy Francis (Legacy Tax + Trust Lawyers) will be co-presenting to the CBABC Vancouver Wills and Trusts Section on “Ethics for Trust and Estate Practitioners: Managing Conflicts of Interest”.
Roselle Wu will provide a summary of recent jurisprudence on conflicts of interest, both generally and in the context of estates, and prepared a coloured diagram illustrating the three dimensions of the duty of loyalty to the client. Amy Francis will discuss some conflict of interest issues that are unique to the estate bar, including acting for spouses on a joint retainer to prepare wills, and the conflicts that arise when a lawyer acts as legal advisor and executor. Because of the different roles that lawyers often play in the context of the administration of an estate, conflicts of interest are a common issue, and managing them appropriately and ethically is an important part of any estates practice.
